Amendment No. 37 was offered by Representative Berkowitz: Page 5, following line 26: Insert a new subsection to read: "(l) The tax rate in subsection (e) of this section, is contingent on the signing and enactment of a fiscal contract under AS 43.82 by September 1, 2006, that requires the private parties to the contract to act in good faith to begin construction of the pipeline by a specified date and requires the parties to act in good faith to complete construction of the Alaska portion of the pipeline by August 30, 2018. For every month after September 2006 that these conditions are not met, the tax rate under subsection (e) will increase to a rate of 25 percent for fields north of the drainage divide of the Brooks Range in production before May 21, 2006, and producing more than 75,000 barrels per day."
